HIPAA Violation - Dr. Tabor
On June 20, 2018, I went to see Dr. Tabor who informed me of a possible problem with a previous root canal. I asked him to send the x-ray to my out of state endodontist who did the first procedure.
I went out to the front office and passed on the message for Mindy, part of the front office staff, to email the x-ray and that I was then going to email the endodontist myself, giving her a “heads up” and take it from there.
I wanted this to be done not only for a second opinion, but I knew this treatment had to be redone by another endodontist in the area, not a general dentist.
My endodontist in Indiana confirmed this by sending me an email back saying that I need to go to a periodontist or oral surgeon and that a 3D scan was needed.
The next day I received a 35 minute phone call from Dr. Tabor expressing his displeasure that I called this endodontist saying that she was the “better dentist”. He also said, “in fact I talked to her in great length and I can't do your treatment due to the sedition that you need”.
I already knew this to start with, that's why I was sending the email to the endodontist who did the previous treatment. I was upset that he would call about this and violate HIPAA laws.
I do not have insurance and I am paying out-of-pocket through CareCredit should I have any treatment done.
Their form states:
"If you paid out-of-pocket for a service or item, you have the right to request that information not be disclosed to a health plan for purposes of payment or health care operations and we are required to honor that request. You may request in writing to our Privacy Officer not to use or disclose any part of your PHI for the purposes of treatment, payment or health care operations such as to family members or friends involved in your care or for notification purposes as described in this Notice of Privacy Practices.”
I have a timeline of when Dr. Tabor got off of the phone with me and an email following within the half-hour from that phone call from my previous endodontist. She now stated that I don't need the 3D x-ray; just have the tooth pulled. I find this very strange to all of a sudden change opinions regarding the treatment.
I did not give written or verbal permission that Dr. Tabor could talk with my previous endodontist simply because I did not think it was needed. I knew that I could not have this type of work done by a general dentist. Dr. Tabor assumed that he was going to be the one doing it.
This was not all that Dr. Tabor had issue with on his 35 minute phone call to me, but space will not allow.
